3. Accessing the Service

3.1 In order to use our Services, you must be a bank account holder and a resident of a European Union, European Economic Area (EEA) member state, United Kingdom or Canada.

3.2 You must be at least eighteen (18) years old to access or use the Service as a Sender. You must be able to enter into legally binding contracts under applicable law, including local law in the jurisdiction in which you live. We may ask you at any time to show proof of your age.

3.3 As a Receiver, you must be able to enter into legally binding contracts under applicable law, including local law in the jurisdiction in which you live.

3.4 If you are not a Consumer, you confirm that you have authority to bind any business on or entity as a Sender or Receiver on whose behalf you seek to use the site or our Services and that business or entity accepts these terms in full.

3.5 We are not obliged to process any particular Transaction. When you submit a Transaction Request, you are requesting that we process the Transaction on your behalf and consenting to the execution of the Transaction. This is an offer which we may accept or reject at our sole discretion.

3.6 We may, in our absolute discretion, refuse or cancel any Transaction Request or impose limits on the Transaction Amount we may do so either on a per Transaction basis or on an aggregate basis, and either in respect of one set of registration details or one Payment Instrument or on related sets of registration details or Payment Instruments.

3.7 In that case, we will notify you promptly of that decision and refund you the Transaction Amount received by us, provided that we are not prohibited by law from doing so.

4.Using the Service

4.1 You don’t need to register for a Bazar Money Transfer account in order to visit or use most areas of our website or our live chat application. However, to use the Service and access restricted areas of our website and or live chat application you will need to register and set up an account with us (your “Account“).

4.2 Your use of the Service requires an account identifying you as a user of the Service (an “Account”). 6.1 you can transfer money from any of the supported countries as a sender to any of the supported countries using our money remittance service. However, we may stop providing our service to any of these countries without a further notice. To be able to make a transfer we may ask you to provide us with details of the recipients and further payment instructions including recipients name, bank account details, transaction amount, reference. Also, the responsibility is all yours to make sure that all the required details to make a transaction are correct and accurate. In case of any incorrect details the transaction may result in delay or could cancel the transaction. However, if the transaction is been authorised, submitted and made it might not be possible to cancel it at that stage.

the actual amount that your recipient receives might be a different from what has been provided on the website as there might be additional fees added to the transfer that you made by banks or other service providers.

the next step after your initial request is to make a payment therefore, we will provide you with our bank account details to deposit the transaction amount also the transaction fee if applicable. after we receive the transaction amount and fee. the transaction will be authorised by Bazar Money Transfer, afterward we will credit the Transaction Amount onto the Recipient bank account in the currency requested by you. We would not contact any of our recipients when funds are available to their accounts.

delivery time of the funds on our website are estimated for a normal average transaction time but is not guaranteed for all our transactions. There are some reasons that might cause a delivery delay for instance: if we fail to verify your identity, if we are not to validate your transaction instructions, or if not complying by law or differentiation in business hours also any currency availability. By business day we mean a weekday not Saturday, Sunday or bank holidays in UK or any day that bans are open in the recipients’ country.

Bazar Money Transfer is not responsible for any delay caused by the cut off time when banks stop dispatching electronic payments.

if any incorrect amount has been transferred to our recipients account by Bazar Money Transfer, we hold the right to take a legal action if the recipient refuse to refund the funds.

7.Your payment details

7.1 We will ask you to provide details of the payment instrument you wish to use, such as your credit card, debit card or bank account (your “Payment Instrument“) so that we can collect payment from you when you initiate a transaction.

7.2 Where relevant, you authorise us to debit your chosen Payment Instrument with the Transaction Amount and Transaction Fee. You represent and warrant that you are the lawful owner of these Payment Instrument(s) and that the details you supply to us are accurate.

7.3 If your payment fails or is insufficient, you authorise us to re-try one or more times to debit your selected Payment Instrument.

7.4 Both you and the Recipient will only act on your own behalf. You may not submit an Instruction or receive a Transaction on behalf of a third person.

7.5 Bazar Money Transfer will have no responsibility for any fees or charges you may incur by the use of a particular Payment Instrument to fund a Transaction. These may include but are not limited to unauthorised overdraft fees imposed by banks if there are insufficient funds in your bank account or “cash advance” fees and additional interest which may be imposed by credit card providers if they treat use of the Service as a cash transaction rather than a purchase transaction.

8. Exchange rates

The conversion rate showing on the system is just for that time and date shown on the screen it may fluctuate and differ time to time.

the exchange rate would still apply if there is a delay in making the transaction.If you pay for the transaction in one currency and your recipient is paid by us in another currency there might be a slight different between the rate at which we would buy the foreign currency and the rate provided to you.

9.Other fees, charges, and interest

In case you make a transaction that BMT would become liable to pay any fee, charges or any other fees such as overdraft fees apply by banks if there are not sufficient funds in your account or “cash advance“ fees or any additional interest which may be applied by credit card providers if they treat use of the Service as a cash transaction rather than a purchase transaction and you agree to refund us all such fee.

You authorise us to get access to charge or debit funds from any of your payment institutions or banks to be able to receive payments from you.

We would not be reliable for paying any charge applied by the receipt bank when recipients receiving funds in their accounts. The recipient s bank should be contacted if any charges or fees apply to transaction by their bank. Also, in case of any intermediate bank fees applies BMT would refuse to pay such fee and is not liable to cover those charges.

you would not be entitled to any interest for the time of money being remitted or pending time or in any time of money remittance. BMT may decide to limit the amount of transaction in one transaction or on any agreed basis.

10. Cancellation and Refund

Your agreements with us can be cancelled even after you have submitted a transaction.

If you would like to cancel a transaction or request a refund you can send us an email to helpdesk@BazarMoneyTransfer.com or contact us by phone using our phone numbers provided at the end of this terms and conditions.

the cancelation or refund only would take place if we could identify you as the sender. In order for us to identify you need to send us an email from your registered email address with us, provide your full name and address with the reference or identification number of your transaction the amount of the transaction, the reasoning behind the request. Also consider that the refund would only be credited to the same account in same currency except the bank account could not be found or identified.

In case we can not identify the senders account we would contact sender asking for the same currency account details.

10.7 In circumstances when the payment has already been credited to the Recipient’s bank account, and a Sender requires a recall of the funds, they may do so. However Bazar Money Transfer cannot guarantee cancellation will be successful.

10.8 In those circumstances we would make reasonable efforts to recover the funds. We may charge you a reasonable fee, reflective of our efforts, to do so. However there is no guarantee that the cancellation will be successful.

11. Collection of Information

11.1 We are regulated by the HMRC and FCA in UK and by the FINTRAC in Canada.

11.2 UK and Canada law requires all financial institutions to obtain, verify, and record identifying information about all its customers. We may therefore require you to supply us with personal identifying information and we may also legally consult other sources to obtain information about you. In accordance with our obligations under The Money Laundering Regulations 2017 and any other applicable laws of the United Kingdom and Canada or of the country from which funds are transferred or where funds are intended to be received. 12.5 We will notify you as soon as we can if we are unable to perform a transaction for any of these reasons and will use reasonable measures to secure the return of any money paid by you.

12.6 To the extent permitted under any applicable law, in no event shall Bazar Money Transfer, our subsidiaries, officers, agents, partners, or employees be responsible to you in any way beyond the sum of £1000.00 (in addition, when applicable, to refunding the transaction amount and transaction fees).

12.7 However, in the event that we make a payment transfer that is not in accordance with your instructions (for example, we send the transfer to the wrong Recipient), we will refund you that payment in full.

12.8 For security reasons, we recommend that you only send money through the Service to people you know personally.

12.9 If you choose to pay third parties for goods and services using the Service, you acknowledge that Bazar Money Transfer has no control over, and is not responsible for, the quality, safety, legality, or delivery of such goods or services and that any such use of the Service is entirely at your own risk.

13. Force majeure

13.1 In an “Event of Force Majeure” i.e. any circumstance not within the reasonable control of Bazar Money Transfer, but only if and to the extent that:

13.1.1 Such circumstance, despite the exercise of reasonable diligence, cannot be, or be caused to be, prevented, avoided or removed by Bazar Money Transfer. Bazar Money Transfer will not be held liable.
